<p>Dr. Rand has become increasingly well known in both the addiction and chronic pain communities for his innovative and progressive approach in dealing with both diagnoses. In addition to his extensive experience directing multiple treatment centers, Dr. Rand has also traveled the country speaking to other physicians regarding multiple topics involving dual-diagnostic treatment, including the complexities surrounding the use and abuse of opiate medications.  Not only does Dr. Rand conduct lecture series regarding the complexity of pain and addiction treatment, he has also written and published several journal articles on this topic.  In addition, he has been featured on the award winning A&amp;E Show “Intervention”, as well as the Fox Morning Show, and the radio show titled “Just for Today.”</p>
<p>Bay Recovery, the treatment center where Dr. Rand currently practices, is one of a kind in its’ approach to dual-diagnosis and chronic pain treatment.  The mission of Bay Recovery is to provide a safe and supportive environment for individuals whose lives have been impaired by chronic pain, chemical dependency, or a dual diagnosis. <p>Allen Ling is &#8220;The Chronic Pain Educational Documentary Series&#8217;&#8221; new asset to join out team of experts.  Allen earned his BS in Microbiology and Immunology at UC Berkeley and his Master of Physical Therapy at USC inLos Angeles, CA.  He is also a board Certified Specialist in Orthopedic Physical Therapy (OCS), an APTA Certified Clinical Instructor, one of the first instructors nationwide to practice Aquatic Physical Therapy, certified in kinesiotaping and a certified WATSU instructor.  In addition Allen has completed long term residencies in Proprioceptive Neuromuscular Facilitation (proprioceptive neuromuscular facilitation) from Kaiser Vallejo Rehab Center and Orofacial and TMD from the UCSF Center for Orofacial and Temporomandibular Dysfunction Center. Over the span of his career, Allen has taken over 160 courses, residencies, and workshops in Physical Therapy treatment and philosophy. He has also taken two dozen workshops and courses in marketing and business management. Allen has taught over 2 dozen workshops and courses across the country in Aquatic Physical Therapy, Sports Medicine, and ethical business development. He is also an appointed member of the California Chapter American Physical Therapy Association Committee regarding Referral for Profit. Allen assists the Committee members with decision making, strategies and state policies involved with Medical Doctors referring patients to physical therapy clinics in which doctors themselves have ownership. He was also appointed CPTA Ethics Investigator for Northern California, is a member of the CPTA Ethics Committee, and is on the CPTA subcommittee for continuing education course approval. Allen is a member of the American Physical Therapy Association (APTA), a national professional organization of physical therapists, for over two decades.</p>

<p>Allen accepted a teaching position at Albany High School affiliated with the Contra Costa ROP program. He was an instructor for a Sports Medicine class as well as spent time treating the injured athletes at AHS.</p>
<p>Allen is a cancer survivor since 2005, and continues to mentor other physical therapists and PT students . He enjoys treating young children as well as being present for end stage cancer patients. Allen continues to evaluate and treat patients full-time; he also finds time to write articles. His approach on the use of weights versus buoyancy, &#8220;Weight and See the Results&#8221; was published in &#8220;Physical Therapy Products&#8221;, January/February 2004.</p>

<p>It is with great pleasure to announce another great addition to our team of experts specializing in areas related to chronic pain <a title="Dr. Jerry Rand, MD" href="http://www.bayrecovery.com/rand.html" target="_blank">Dr. Jerry Rand, MD.</a></p>
<p>Dr. Rand completed medical school in 1972. Since that time he has worked in numerous treatment settings, initially within medical hospitals and emergency rooms. Since 1994 he has directed and developed many treatment programs for the patient suffering from pain and addictive and chemical dependency disorders. As a chronic pain and chemical dependency specialist In 1992 Dr. Rand founded <a title="Bay Recovery Centers" href="http://www.bayrecovery.com/index.html" target="_blank">Bay Recovery Centers</a> in the San Diego, CA area and since then has successfully treated hundreds of chronic pain patients with various pain conditions and chemical dependency issues and has help them acquire the tools to lead normal, productive lives and move on to fulfilling, successful careers.  In this capacity he also directs and over-sees other providers who are working within multi-disciplinary teams.  At Bay Recovery Centers Dr Rand works in conjunction with the multidisciplinary team, is able to address pain and chemical dependency treatment through a variety of treatment modalities focusing on physical and psychological health, family relations, developing a social support and cultural factors.</p>
<p>Since a lot of pain medicine management is currently contacted through medication, some highly addictive Dr. Rand&#8217;s knowledge is invaluable to our effort to help us educate on the benefits, pros, cons and possible pitfalls and long term outcomes related to using both prescription medications or self medicating.  For the many who have already developed chemical dependency to drugs without the initial benefits Dr. Rand will serve as an information source who will help educating on how to make the most effective decisions.</p>
<p>Dr. Rand&#8217;s work has been featured several times on <a title="A&amp;E" href="http://www.aetv.com/" target="_blank">A&amp;E</a>&#8216;s <a title="Intervention" href="http://www.aetv.com/intervention/index.jsp" target="_blank">Intervention</a> and he is currently working on producing further content with the &#8220;Chronic Pain Educational Documentary Series&#8221;</p>

Frank H. Lucido, MD has been practicing Family and General Medicine in Berkeley, California since 1979. He graduated from University of Michigan Medical School in 1974, and completed his Family Practice Residency through University of California at Davis in 1977.  In addition, Dr. Lucido, MD, has been a strong proponent of the California Compassionate Use Act of 1996 he has been performing Medical Cannabis evaluations, and has written and lectured on the subject. <p>Frank H. Lucido, MD has been practicing Family and General Medicine in Berkeley, California since 1979. <p>Even before the passage of the California Compassionate Use Act of 1996 medical cannabis has been mentioned quite often in the context of pain management and often used as a remedy.  Because of the controversy, and the legal issues surrounding medical cannabis as educators, with the help of professionals on either side of the controversy &#8220;The Chronic Pain Educational Documentary Series&#8221; will explore the issue so interested parties can decide where they stand.</p>
<p>In 2004, Dr. Lucido, co-authored the widely read article “Implementation of the Compassionate Use Act in a Family Medical Practice, Seven Years’ Clinical Experience” with Mariavittoria Mangini, PhD, FNP, published in O’Shaughnessy’s, the Journal of the Society of Cannabis Clinicians. This article is designed to be a blueprint for physicians in making safe and appropriate recommendations.</p>
<p>In 2004, Dr. Lucido, MD, founded MedicalBoardWatch.com to keep watch on Medical Board of California actions against physicians who make medical cannabis recommendations.</p>
<p>Dr. Lucido, MD,  is also founder of Lucido Medical-Legal Consulting, to give expert medical testimony for legitimate patients who use cannabis medicinally, and for responsible physicians who recommend it appropriately, both in California, as well as in other states.</p>
<p>He lectures on medical cannabis, and practice standards, and is particularly interested in speaking to physician groups to increase the number of responsible physicians willing to make appropriate recommendations for this safe and effective medicine.</p>
<p>Dr. Lucido is a member of Society of Cannabis Clinicians, Physicians for Social Responsibility and now one of our carefully selected advisors on &#8220;The Chronic Pain Educational Documentary Series.&#8221;</p>
<p>The Chronic Pain Educational Documentary Series&#8221; goal is to raise awareness and educate on the issues related to chronic pain prevention, management and recovery where possible.</p>

<p>I urge you to donate to reputable, established organizations actively involved in the Haitian earthquake relief effort.  Please verify that the organization of your choice has a good track record and can account where and how funds will be allocated.  Also I recommend that you support organizations with no other concurrent political, religious or profit driven agenda other than immediate relief efforts and long term infostructure development.  Healthcare organizations, particularly the ones with history of active involvement in the ongoing effort of physical pain management and education are particularly recommended.</p>
<p>&#8220;The Chronic Pain Educational Documentary Series&#8221; supports the Haitian earthquake relief effort, however neither endorses nor is actively affiliated with any organizations currently involved in the current crisis, including the ones listed below.</p>

It is with with great pain and deep sadness I have to announce that Kim Norwood, my friend and Director of Photography for "The Chronic Pain Educational Documentary Series," has passed away on Sunday, December 20th, 2009 due to liver metastatic cancer complications.  Kim’s 22 year battle with hairy cell Leukemia and chronic pain combined with an Emmy Award (4) 35 year broadcasting career experience he shared with my valuable team made him an indispensable member of our team's effort to educate on the issues related to chronic pain. <p>It is with with great pain and deep sadness I have to announce that Kim Norwood, my friend and Director of Photography for &#8220;The Chronic Pain Educational Documentary Series,&#8221; has passed away on Sunday, December 20th, 2009 due to liver metastatic cancer complications.  Kim’s 22 year battle with hairy cell Leukemia and chronic pain combined with an Emmy Award (4) 35 year broadcasting career experience he shared with my valuable team made him an indispensable member of our team&#8217;s effort to educate on the issues related to chronic pain.  He will be missed greatly.</p>
<p>During the past year that I have been fortunate to work and become friends with Kim he has been a driving force and constant source of inspiration.  Kim&#8217;s life experience will serve as reminder of why &#8220;The Chronic Pain Educational Series&#8221; have started and how we have all discovered each other set on our mission to educate on the issues related to chronic pain.</p>
<p>Kim, thank you for your humanity, your friendship your great work and most of all for being courageous, honest and authentic.   Wherever you might be at I wish you are cancer and pain free, safe, loved and pampered with joy, fulfillment and pleasure should you wish toying with the best camera your mind can conceive, your hands can operate and your eyes can record through.  Thank you and have a good trip.</p>
<p>Kim was survived by family, siblings, his father, a few friends, colleagues, the numerous people that treated him over the years, the millions that struggle to battle cancer and chronic pain day after day and the many millions around the world who have witnessed countless hours of 4 different Olympic events coverage through his eyes and ears.  As an independent Cinematographer Kim had made an equal contribution and his work will be seen in 2010 through “The Chronic Pain Educational Documentary Series,” and his spirit will leave on.  My sympathies go to his family members, friends and everyone Kim&#8217;s life has touched.</p>

<p>Remarks of President Barack Obama – As Prepared for Delivery  Signing of Stem Cell Executive Order and Scientific Integrity Presidential Memorandum Washington, DC March 9, 2009</p>
<p>Today, with the Executive Order I am about to sign, we will bring the change that so many scientists and researchers; doctors and innovators; patients and loved ones have hoped for, and fought for, these past eight years: we will lift the ban on federal funding for promising embryonic stem cell research. We will vigorously support scientists who pursue this research. And we will aim for America to lead the world in the discoveries it one day may yield.  At this moment, the full promise of stem cell research remains unknown, and it should not be overstated. But scientists believe these tiny cells may have the potential to help us understand, and possibly cure, some of our most devastating diseases and conditions. To regenerate a severed spinal cord and lift someone from a wheelchair. To spur insulin production and spare a child from a lifetime of needles. To treat Parkinson’s, cancer, heart disease and others that affect millions of Americans and the people who love them.  But that potential will not reveal itself on its own. Medical miracles do not happen simply by accident. They result from painstaking and costly research – from years of lonely trial and error, much of which never bears fruit – and from a government willing to support that work. From life-saving vaccines, to pioneering cancer treatments, to the sequencing of the human genome – that is the story of scientific progress in America. When government fails to make these investments, opportunities are missed. Promising avenues go unexplored. Some of our best scientists leave for other countries that will sponsor their work. And those countries may surge ahead of ours in the advances that transform our lives.  But in recent years, when it comes to stem cell research, rather than furthering discovery, our government has forced what I believe is a false choice between sound science and moral values. In this case, I believe the two are not inconsistent. As a person of faith, I believe we are called to care for each other and work to ease human suffering. I believe we have been given the capacity and will to pursue this research – and the humanity and conscience to do so responsibly.  It is a difficult and delicate balance. Many thoughtful and decent people are conflicted about, or strongly oppose, this research. I understand their concerns, and we must respect their point of view.  But after much discussion, debate and reflection, the proper course has become clear. The majority of Americans – from across the political spectrum, and of all backgrounds and beliefs – have come to a consensus that we should pursue this research. That the potential it offers is great, and with proper guidelines and strict oversight, the perils can be avoided.  That is a conclusion with which I agree. That is why I am signing this Executive Order, and why I hope Congress will act on a bi-partisan basis to provide further support for this research. We are joined today by many leaders who have reached across the aisle to champion this cause, and I commend them for that work.  Ultimately, I cannot guarantee that we will find the treatments and cures we seek. No President can promise that. But I can promise that we will seek them – actively, responsibly, and with the urgency required to make up for lost ground. Not just by opening up this new frontier of research today, but by supporting promising research of all kinds, including groundbreaking work to convert ordinary human cells into ones that resemble embryonic stem cells.  I can also promise that we will never undertake this research lightly. We will support it only when it is both scientifically worthy and responsibly conducted. We will develop strict guidelines, which we will rigorously enforce, because we cannot ever tolerate misuse or abuse. And we will ensure that our government never opens the door to the use of cloning for human reproduction. It is dangerous, profoundly wrong, and has no place in our society, or any society.  This Order is an important step in advancing the cause of science in America. But let’s be clear: promoting science isn’t just about providing resources – it is also about protecting free and open inquiry. It is about letting scientists like those here today do their jobs, free from manipulation or coercion, and listening to what they tell us, even when it’s inconvenient – especially when it’s inconvenient. It is about ensuring that scientific data is never distorted or concealed to serve a political agenda – and that we make scientific decisions based on facts, not ideology.  By doing this, we will ensure America’s continued global leadership in scientific discoveries and technological breakthroughs. That is essential not only for our economic prosperity, but for the progress of all humanity.  That is why today, I am also signing a Presidential Memorandum directing the head of the White House Office of Science and Technology Policy to develop a strategy for restoring scientific integrity to government decision making. To ensure that in this new Administration, we base our public policies on the soundest science; that we appoint scientific advisors based on their credentials and experience, not their politics or ideology; and that we are open and honest with the American people about the science behind our decisions. That is how we will harness the power of science to achieve our goals – to preserve our environment and protect our national security; to create the jobs of the future, and live longer, healthier lives.  As we restore our commitment to science, and resume funding for promising stem cell research, we owe a debt of gratitude to so many tireless advocates, some of whom are with us today, many of whom are not. Today, we honor all those whose names we don’t know, who organized, and raised awareness, and kept on fighting – even when it was too late for them, or for the people they love. And we honor those we know, who used their influence to help others and bring attention to this cause – people like Christopher and Dana Reeve, who we wish could be here to see this moment.  One of Christopher’s friends recalled that he hung a sign on the wall of the exercise room where he did his grueling regimen of physical therapy. It read: &#8220;For everyone who thought I couldn’t do it. For everyone who thought I shouldn’t do it. For everyone who said, ‘It’s impossible.’ See you at the finish line.&#8221;  Christopher once told a reporter who was interviewing him: &#8220;If you came back here in ten years, I expect that I’d walk to the door to greet you.&#8221;  Christopher did not get that chance. But if we pursue this research, maybe one day – maybe not in our lifetime, or even in our children’s lifetime – but maybe one day, others like him might.  There is no finish line in the work of science. The race is always with us – the urgent work of giving substance to hope and answering those many bedside prayers, of seeking a day when words like &#8220;terminal&#8221; and &#8220;incurable&#8221; are finally retired from our vocabulary.  Today, using every resource at our disposal, with renewed determination to lead the world in the discoveries of this new century, we rededicate ourselves to this work. <p>To amend the Public Health Service Act with respect to pain care.</p>

<p>1 SECTION 1. SHORT TITLE; TABLE OF CONTENTS.</p>
<p>2	(a) SHORT TITLE.—This Act may be cited as the</p>
<p>3	‘‘National Pain Care Policy Act of 2008’’.</p>
<p>4	(b) TABLE OF CONTENTS.—The table of contents of</p>
<p>5	this Act is as follows:</p>
<p>Sec. 1. Short title; table of contents. Sec. 2. Institute of Medicine Conference on Pain. Sec. 3. Pain research at National Institutes of Health. Sec. 4. Pain care education and training. Sec. 5. Public awareness campaign on pain management.</p>
<p>6 SEC. 2. INSTITUTE OF MEDICINE CONFERENCE ON PAIN. 7	(a) CONVENING.—Not later than June 30, 2009, the 8 Secretary of Health and Human Services shall seek to 9 enter into an agreement with the Institute of Medicine of</p>
<p>10 the National Academies to convene a Conference on Pain 11	(in this section referred to as ‘‘the Conference’’). 12	(b) PURPOSES.—The purposes of the Conference 13	shall be to—</p>
<p>14 15 16 17 18 19 20 21 22</p>
<p>(1) increase the recognition of pain as a signifi- cant public health problem in the United States;</p>
<p>(2) evaluate the adequacy of assessment, diag- nosis, treatment, and management of acute and chronic pain in the general population, and in identi- fied racial, ethnic, gender, age, and other demo- graphic groups that may be disproportionately af- fected by inadequacies in the assessment, diagnosis, treatment, and management of pain;</p>

<p>3 (3) identify barriers to appropriate pain care,</p>
<p>including— (A) lack of understanding and education</p>
<p>among employers, patients, health care pro- viders, regulators, and third-party payors;</p>
<p>(B) barriers to access to care at the pri- mary, specialty, and tertiary care levels, includ- ing barriers—</p>
<p>(i) specific to those populations that are disproportionately undertreated for pain;</p>
<p>(ii) related to physician concerns over regulatory and law enforcement policies applicable to some pain therapies; and</p>
<p>(iii) attributable to benefit, coverage, and payment policies in both the public and private sectors; and (C) gaps in basic and clinical research on</p>
<p>the symptoms and causes of pain, and potential assessment methods and new treatments to im- prove pain care; and (4) establish an agenda for action in both the</p>
<p>public and private sectors that will reduce such bar- riers and significantly improve the state of pain care</p>

<p>States.</p>
<p>(c) OTHER APPROPRIATE ENTITY.—If the Institute of Medicine declines to enter into an agreement under sub- section (a), the Secretary of Health and Human Services may enter into such agreement with another appropriate entity.</p>
<p>(d) REPORT.—A report summarizing the Con- ference’s findings and recommendations shall be sub- mitted to the Congress not later than June 30, 2010.</p>
<p>(e) AUTHORIZATION OF APPROPRIATIONS.—For the purpose of carrying out this section, there is authorized to be appropriated $500,000 for each of fiscal years 2009 and 2010. SEC. 3. PAIN RESEARCH AT NATIONAL INSTITUTES OF</p>
<p>HEALTH.</p>
<p>Part B of title IV of the Public Health Service Act (42 U.S.C. 284 et seq.) is amended by adding at the end the following: ‘‘SEC. 409J. PAIN RESEARCH.</p>
<p>‘‘(a) RESEARCH INITIATIVES.— ‘‘(1) IN GENERAL.—The Director of NIH is en-</p>

<p>2	ments for pain. 3	‘‘(2) ANNUAL RECOMMENDATIONS.—Not less 4	than annually, the Pain Consortium, in consultation 5	with the Division of Program Coordination, Plan- 6	ning, and Strategic Initiatives, shall develop and 7	submit to the Director of NIH recommendations on 8	appropriate pain research initiatives that could be 9	undertaken with funds reserved under section</p>
<p>10	402A(c)(1) for the Common Fund or otherwise 11	available for such initiatives. 12	‘‘(3) DEFINITION.—In this subsection, the term 13	‘Pain Consortium’ means the Pain Consortium of 14	the National Institutes of Health or a similar trans- 15	National Institutes of Health coordinating entity 16	designated by the Secretary for purposes of this sub- 17	section.</p>
<p>18	‘‘(b) INTERAGENCY PAIN RESEARCH COORDINATING 19 COMMITTEE.—</p>

<p>‘‘(i) 6 members shall be appointed from among scientists, physicians, and other health professionals, who—</p>
<p>‘‘(I) are not officers or employees of the United States;</p>
<p>‘‘(II) represent multiple dis- ciplines, including clinical, basic, and public health sciences;</p>
<p>‘‘(III) represent different geo- graphical regions of the United States; and</p>
<p>‘‘(IV) are from practice settings, academia, manufacturers or other re- search settings; and ‘‘(ii) 6 members shall be appointed</p>
<p>from members of the general public, who are representatives of leading research, ad- vocacy, and service organizations for indi- viduals with pain-related conditions</p>

<p>8 ‘‘(C) NONVOTING MEMBERS.—The Com-</p>
<p>mittee shall include such nonvoting members as the Secretary determines to be appropriate. ‘‘(3) CHAIRPERSON.—The voting members of</p>
<p>the Committee shall select a chairperson from among such members. The selection of a chairperson shall be subject to the approval of the Director of NIH.</p>
<p>‘‘(4) MEETINGS.—The Committee shall meet at the call of the chairperson of the Committee or upon the request of the Director of NIH, but in no case less often than once each year.</p>
<p>‘‘(5) DUTIES.—The Committee shall— ‘‘(A) develop a summary of advances in pain care research supported or conducted by the Federal agencies relevant to the diagnosis, prevention, and treatment of pain and diseases</p>
<p>and disorders associated with pain; ‘‘(B) identify critical gaps in basic and</p>
<p>clinical research on the symptoms and causes of pain;</p>
<p>‘‘(C) make recommendations to ensure that the activities of the National Institutes of Health and other Federal agencies, including the Department of Defense and the Department</p>

<p>plication of effort; ‘‘(D) make recommendations on how best</p>
<p>to disseminate information on pain care; and ‘‘(E) make recommendations on how to ex- pand partnerships between public entities, in- cluding Federal agencies, and private entities to</p>
<p>expand collaborative, cross-cutting research.</p>
<p>‘‘(6) REVIEW.—The Secretary shall review the necessity of the Committee at least once every 2 years.’’.</p>
<p>SEC. 4. PAIN CARE EDUCATION AND TRAINING.</p>
<p>(a) PAIN CARE EDUCATION AND TRAINING.—Part D of title VII of the Public Health Service Act (42 U.S.C. 294 et seq.) is amended—</p>
<p>(1) by redesignating sections 754 through 758 as sections 755 through 759, respectively; and</p>
<p>(2) by inserting after section 753 the following:</p>
<p>‘‘SEC. 754. PROGRAM FOR EDUCATION AND TRAINING IN PAIN CARE.</p>
<p>‘‘(a) IN GENERAL.—The Secretary may make awards of grants, cooperative agreements, and contracts to health professions schools, hospices, and other public and private entities for the development and implementation of pro-</p>

<p>2	professionals in pain care. 3	‘‘(b) PRIORITIES.—In making awards under sub- 4 section (a), the Secretary shall give priority to awards for 5	the implementation of programs under such subsection. 6	‘‘(c) CERTAIN TOPICS.—An award may be made 7 under subsection (a) only if the applicant for the award 8 agrees that the program carried out with the award will 9	include information and education on—</p>

<p>‘‘(1) recognized means for assessing, diag- nosing, treating, and managing pain and related signs and symptoms, including the medically appro- priate use of controlled substances;</p>
<p>‘‘(2) applicable laws, regulations, rules, and policies on controlled substances, including the de- gree to which misconceptions and concerns regarding such laws, regulations, rules, and policies, or the en- forcement thereof, may create barriers to patient ac- cess to appropriate and effective pain care;</p>
<p>‘‘(3) interdisciplinary approaches to the delivery of pain care, including delivery through specialized centers providing comprehensive pain care treatment expertise;</p>

<p>11 ‘‘(4) cultural, linguistic, literacy, geographic,</p>
<p>and other barriers to care in underserved popu- lations; and</p>
<p>‘‘(5) recent findings, developments, and im- provements in the provision of pain care. ‘‘(d) PROGRAM SITES.—Education and training</p>
<p>under subsection (a) may be provided at or through health professions schools, residency training programs, and other graduate programs in the health professions; entities that provide continuing education in medicine, pain man- agement, dentistry, psychology, social work, nursing, and pharmacy; hospices; and such other programs or sites as the Secretary determines to be appropriate.</p>
<p>‘‘(e) EVALUATION OF PROGRAMS.—The Secretary shall (directly or through grants or contracts) provide for the evaluation of programs implemented under subsection (a) in order to determine the effect of such programs on knowledge and practice of pain care.</p>
<p>‘‘(f) PEER REVIEW GROUPS.—In carrying out section 799(f) with respect to this section, the Secretary shall en- sure that the membership of each peer review group in- volved includes individuals with expertise and experience in pain care.</p>
<p>‘‘(g) DEFINITIONS.—For purposes of this section the term ‘pain care’ means the assessment, diagnosis, treat-</p>

<p>of causation or body location.’’. (b) AUTHORIZATION OF APPROPRIATIONS.—Section</p>
<p>758(b)(1) of the Public Health Service Act (as redesig- nated by subsection (a)(1) of this section) is amended— (1) by striking ‘‘and’’ at the end of subpara-</p>
<p>graph (B); (2) by striking the period at the end of sub-</p>
<p>paragraph (C) and inserting ‘‘; and’’; and (3) by inserting after subparagraph (C) the fol-</p>
<p>lowing:</p>
<p>‘‘(D) not less than $5,000,000 for awards of grants, cooperative agreements, and con- tracts under sections 754.’’.</p>
<p>(c) TECHNICAL AMENDMENTS.—Title VII of the Public Health Service Act (42 U.S.C. 292 et seq.) is amended—</p>
<p>(1) in paragraph (2) of section 757(b) (as re- designated by subsection (a)(1)), by striking ‘‘754(3)(A), and 755(b)’’ and inserting ‘‘755(3)(A), and 756(b)’’; and</p>
<p>(2) in subparagraph (C) of section 758(b)(1) (as redesignated by subsection (a)(1)), by striking ‘‘754, and 755’’ and inserting ‘‘755, and 756’’.</p>

<p>SEC. 5. PUBLIC AWARENESS CAMPAIGN ON PAIN MANAGE- MENT.</p>
<p>Part B of title II of the Public Health Service Act (42 U.S.C. 238 et seq.) is amended by adding at the end the following: ‘‘SEC. 249. NATIONAL EDUCATION OUTREACH AND AWARE-</p>
<p>NESS CAMPAIGN ON PAIN MANAGEMENT.</p>
<p>‘‘(a) ESTABLISHMENT.—Not later than June 30, 2009, the Secretary shall establish and implement a na- tional pain care education outreach and awareness cam- paign described in subsection (b).</p>
<p>‘‘(b) REQUIREMENTS.—The Secretary shall design the public awareness campaign under this section to edu- cate consumers, patients, their families, and other care- givers with respect to—</p>
<p>‘‘(1) the incidence and importance of pain as a national public health problem;</p>
<p>‘‘(2) the adverse physical, psychological, emo- tional, societal, and financial consequences that can result if pain is not appropriately assessed, diag- nosed, treated, or managed;</p>
<p>‘‘(3) the availability, benefits, and risks of all pain treatment and management options;</p>
<p>‘‘(4) having pain promptly assessed, appro- priately diagnosed, treated, and managed, and regu- larly reassessed with treatment adjusted as needed;</p>

<p>14 ‘‘(5) the role of credentialed pain management</p>
<p>specialists and subspecialists, and of comprehensive interdisciplinary centers of treatment expertise;</p>
<p>‘‘(6) the availability in the public, nonprofit, and private sectors of pain management-related in- formation, services, and resources for consumers, employers, third-party payors, patients, their fami- lies, and caregivers, including information on—</p>
<p>‘‘(A) appropriate assessment, diagnosis, treatment, and management options for all types of pain and pain-related symptoms; and</p>

<p>2	under this section. 3	‘‘(2) AGENCY COORDINATION.—The Secretary 4	shall ensure the involvement in the public awareness 5	campaign under this section of the Surgeon General 6	of the Public Health Service, the Director of the 7	Centers for Disease Control and Prevention, and 8	such other representatives of offices and agencies of 9	the Department of Health and Human Services as</p>
<p>10	the Secretary determines appropriate. 11	‘‘(e) UNDERSERVED AREAS AND POPULATIONS.—In 12 designing the public awareness campaign under this sec- 13	tion, the Secretary shall— 14	‘‘(1) take into account the special needs of geo- 15	graphic areas and racial, ethnic, gender, age, and 16	other demographic groups that are currently under- 17	served; and 18	‘‘(2) provide resources that will reduce dispari- 19	ties in access to appropriate diagnosis, assessment, 20	and treatment. 21	‘‘(f) GRANTS AND CONTRACTS.—The Secretary may 22 make awards of grants, cooperative agreements, and con- 23 tracts to public agencies and private nonprofit organiza- 24 tions to assist with the development and implementation 25	of the public awareness campaign under this section.</p>

<p>16 1	‘‘(g) EVALUATION AND REPORT.—Not later than the</p>
<p>2 end of fiscal year 2011, the Secretary shall prepare and 3 submit to the Congress a report evaluating the effective- 4 ness of the public awareness campaign under this section 5	in educating the general public with respect to the matters 6	described in subsection (b).</p>
<p>7	‘‘(h) AUTHORIZATION OF APPROPRIATIONS.—For 8 purposes of carrying out this section, there are authorized 9 to be appropriated $2,000,000 for fiscal year 2009 and</p>
<p>10	$4,000,000 for each of fiscal years 2010 and 2011.’’. Passed the House of Representatives September 24,</p>
